1. Seller
SAS THEA DESCHAMPS, a simplified joint-stock company with a share capital of €1,000, located at 30 avenue Bernard Blua, Zone artisanale Saint-Claude, 83990 Saint-Tropez. SIRET 106 682 610 00014. VAT FR28106682610. Contact: contact@theadeschamps.fr, 04 22 47 07 13.
2. Scope
These terms and conditions apply to pastry orders placed with SAS THEA DESCHAMPS by individual customers. Consulting and menu creation services for professionals are subject to a separate quote and terms and conditions.
3. Products
Pastries are artisanally made to order. The photographs and videos on the website are for illustrative purposes only: slight differences in appearance are possible. Ingredients and allergens are provided upon request before the order is placed. Pastries are prepared in a workshop that uses gluten, eggs, milk, and nuts: traces of these allergens may be present in all products.
4. Orders and Quotes
All orders must be requested in advance using the website form, via WhatsApp, by phone, or by email. A quote is then sent to the customer, specifying the cake, the number of guests, the date, the delivery location, and the price. No minimum notice period is required, but the order must be requested sufficiently in advance and remains subject to availability.
The order is confirmed upon receipt of payment for the quote. The order will not be prepared until the quote has been paid.
5. Prices
Prices are stated in euros, including all taxes. Any delivery charges will be shown on the quote. The applicable price is the one stated on the accepted quote.
6. Payment
Payment is made at the time of ordering by bank transfer, via a secure payment link, by credit card using a payment terminal, or in cash. An invoice is provided to the customer.
7. Delivery
Delivery is provided by Théa Deschamps exclusively within the Gulf of Saint-Tropez, on the agreed date and within the agreed time slot. The customer agrees to be present or to designate someone to receive the order.
Pastries are fresh products: they must be stored in the refrigerator upon receipt and consumed promptly, according to the instructions provided at delivery.
8. Right of Withdrawal
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to goods that are liable to deteriorate or expire rapidly, nor to goods made to the customer's specifications. Pastry orders therefore cannot be withdrawn.
9. Modifications and Cancellations
Any request for modification or cancellation must be sent as soon as possible to contact@theadeschamps.fr or by phone. As pastries are made to order, paid orders for which preparation has already begun cannot be canceled or refunded.
10. Complaints and Guarantees
Any issue (damaged product, order error) must be reported on the day of delivery with a photograph to contact@theadeschamps.fr. The customer benefits from the legal guarantee of conformity and the guarantee against hidden defects provided by law.
11. Consumer Mediation
In the event of a dispute, the customer must first submit their complaint in writing to contact@theadeschamps.fr in order to seek an amicable solution. If no agreement is reached, the customer has the right to free access to a consumer mediator, in accordance with Articles L612-1 et seq. of the French Consumer Code.
12. Personal Data
The data collected is processed in accordance with the website's Privacy Policy.
13. Governing Law
These terms and conditions are subject to French law.
